Terms of Service

1. Acceptance of Terms

By accessing or using the ROCFcare platform (“Service”), you agree to be bound by these Terms of Service. The Service is operated by Reconstructive Orthopaedics of Central Florida (“ROCF”). If you do not agree to these terms, do not use the Service.

2. Description of Service

ROCFcare is a Remote Therapeutic Monitoring platform that enables patients to report symptoms and communicate with their orthopaedic care team. The Service includes:

• Daily check-in forms for reporting pain, function, and symptoms
• AI-assisted triage and symptom analysis
• Secure messaging between patients and care team
• Recovery tracking and trend monitoring

3. Not a Substitute for Emergency Care

ROCFcare is NOT an emergency service. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

The Service is designed to supplement — not replace — your regular orthopaedic care. It does not provide diagnoses, prescriptions, or emergency medical advice.

4. AI Disclaimer

The Service uses artificial intelligence to analyze patient-reported data and assist clinical staff in prioritizing responses. The AI system:

• Does not make medical diagnoses or treatment decisions
• Is used as a screening tool only, with all results reviewed by licensed clinicians
• May occasionally produce inaccurate assessments — clinical judgment always prevails
• Is not a substitute for professional medical evaluation

5. Patient Responsibilities

As a patient using ROCFcare, you agree to:

• Provide accurate and truthful information in your check-ins
• Report any urgent or worsening symptoms promptly
• Keep your contact information current
• Not share your account credentials with others
• Call 911 or go to the ER for any life-threatening emergency
• Continue attending scheduled appointments with your orthopaedic surgeon

6. Staff Responsibilities

Staff users (physicians, PAs, clinical staff, billing) agree to:

• Access only patient information necessary for their role
• Maintain confidentiality of all patient data
• Not share login credentials
• Report any security concerns immediately
• Follow HIPAA guidelines in all interactions with patient data

7. Cost

There is no cost to patients for using ROCFcare. Remote Therapeutic Monitoring services are billed to your insurance as part of your orthopaedic care. You will never receive a bill from ROCFcare for using this platform.

8. Opt Out

Participation in ROCFcare is voluntary. You may opt out of remote monitoring at any time by notifying our office at (352) 456-0220. Opting out will not affect your orthopaedic care or your relationship with your surgeon.

9. Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. Response times from your care team may vary based on clinical schedules.

10. Limitation of Liability

To the maximum extent permitted by law, ROCF shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is provided “as is” without warranties of any kind, except as required by law.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms shall be resolved in the courts of Marion County, Florida.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
